1. Acceptance of Terms

By accessing or using TermiteAI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

TermiteAI provides AI-assisted generation of Wood-Destroying Organism (WDO) inspection reports. The Service uses artificial intelligence to help licensed pest control professionals create NPMA-33 compliant reports based on their field observations.

3. Inspector Responsibility

The licensed inspector is solely responsible for the accuracy of all inspection data entered into the Service. TermiteAI serves as a report generation tool and does not conduct inspections, verify field observations, or provide pest control advice.

You acknowledge that all reports generated by the Service must be reviewed and approved by a licensed inspector before distribution. The inspector's professional license, judgment, and signature are what validate the report, not the AI-generated content.

4. AI-Generated Content Notice

Reports generated by TermiteAI contain content produced by artificial intelligence models. While we strive for accuracy, AI outputs may contain errors, omissions, or inaccuracies. You are responsible for reviewing all AI-generated content for correctness before using it professionally.

AI-generated narratives, recommendations, and descriptions are suggestions based on the data you provide. They do not constitute professional pest control advice and should be treated as draft content requiring professional review.

5. User Accounts and Licensing

You must provide accurate registration information, including a valid pest control license number where applicable. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

6. Payment Terms

New users receive a limited number of free reports. After free reports are exhausted, a per-report fee applies. All payments are processed securely through Stripe. Fees are non-refundable once a report has been generated.

7. Data Handling

Inspection data, including property information, client details, and photos, are stored securely. You retain ownership of all data you provide. We process your data solely to provide the Service. See our Privacy Policy for details.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TERMITEAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FROM INACCURATE REPORTS, LOST REVENUE, OR PROFESSIONAL LIABILITY CLAIMS.

TERMITEAI'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless TermiteAI from any claims, damages, or expenses arising from your use of the Service, including claims related to inspection reports you generate and distribute.

10. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
